This is the last will and testament of me Emma Williams the wife of
John Williams of Thornbury in the County of Gloucestershire retired
tailor whereas by an indenture dated the twenty fourth of August
1852 and made between John Hodges of the first part my said husband
and myself of the second part and James Hodges of the third part the
piece of garden ground messuage and other buildings erected thereon
and other hereditaments and premises therein described and expressed
to be thereby granted were granted released and conveyed to the said
James Hodges and his heirs subject as to part thereof to the life
estate of the said John Hodges therein (the which has since
determined) to such uses and for such trusts intents and purposes as
I notwithstanding my then present or any future coverture amongst
other ways by my last will and testament or testamentary appointment
in writing should from time to time direct limit or appoint give or
devise the same and whereas by an indenture dated the third day of
December 1867 and made between the said John Hodges of the first
part my said husband and myself of the second part and the said
James Hodges and George Hodges of the third part the messuages or
dwelling houses with the garden thereto adjoining and belonging
hereditaments and premises therein described and expressed to be
thereby granted and conveyed were granted and conveyed subject
nevertheless and charged with certain yearly rents of eight pounds
and eight pounds or such of them as according to events should be
payable as therein aforesaid and to the remedies and powers
thereintofore given and provided for securing the same respectively
to the use of he said James Hodges and George Hodges to such uses as
I should amongst other ways by my last will or any codicil thereto
appoint and whereas under an indenture dated 27th August 1858 and
made between the said John Hodges of the one part and under another
indenture dated 6th day of June 1859 and made between the said John
Hodges of the first part my said husband and myself of the second
part and the said James Hodges of the third part the messuages and
garden hereditaments and premises therein described and expressed to
be thereby granted and conveyed were granted and conveyed to the
said James Hodges and his heirs subject to a certain annuity payable
thereout to the said John Hodges (since deceased) during his life to
such uses and upon and for such trusts intents and purposes and in
such manner and form in every respect as I notwithstanding my then
present or any future coverture amongst other ways by my last and
testament or testamentary appointment in writing should from time to
time direct limit or appoint give or devise the same now therefore
in exercise of the powers for this purpose given to me by the
hereintobefore recited indentures and all the other powers (if any)
in anywise enabling me in this behalf I do by this my last will and
testament direct and appoint my son John Hodges Williams of the town
of Thornbury aforesaid tailor and draper Henry Privett Thurston of
the same place gentleman and Joseph Staley of Kington in the parish
of Thornbury yeoman to be the executors and trustees of this my will
and I do also direct limit and appoint that all and singular of the
messuages tenements hereditaments and premises described in the
hereintobefore recited indentures shall from and immediately after
my decease go remain and be unto the use of said trustees who shall
stand possessed thereof upon trust and to the intent that the income
thereof may be paid to my said husband John Williams and his assigns
in case he shall survive me during his life and from and after his
decease I direct and appoint that the same messuages hereditaments
and premises shall remain and be unto and to the use of my son John
Hodges Williams his heirs and assigns absolutely I give and devise
all the rest and residue of my real and personal estate unto my
trustees upon trust to permit my said husband to use and enjoy the
same to receive the rents and profit thereof during his life and
from and immediately after his decease I give and devise the same
unto my son John Hodges Williams absolutely I declare that my said
trustees may let any hereditaments for the time being either from
year to year or for any terms of years at such rents and subject to
such covenants as they may think fit and I also declare that the
powers of appointing new trustees conferred by statute shall for the
purpose of this my will be vested in my said husband during his life
and upon any appointment under the said statutory power the number
of trustees may be altered provided it be not reduced below two I
direct and declare that it shall be lawful for the Henry Privett
Thurston and every person who shall hereafter become a trustee or
executor of this my will who shall be a solicitor to act by himself
or by his firm as the solicitor or one of the solicitors to my
trustees and executors and shall be entitled to charge for and be
paid for all business to be done by him and all attendances time or
trouble given or bestowed by him in or about the execution of the
trusts and powers of this my will or the management and
administration of my estate real or personal as fully as if he had
not been a trustee or an executor and have been employed by my
trustees or my executors or the beneficiaries under this my will he
shall be entitled to be paid all his charges whether the business
done by him shall be strictly a solicitors business or not and
lastly revoking all former wills by me at any time heretofore made I
declare this to be my last will and testament in witness whereof I
have to this my last will and testament contained in this and three
preceding sheets of paper set my hand this 26th day of February
1895.

presence of us both being present at the same time who in her
presence and in the presence of each other have hereunto subscribed
our names as witnesses:

On the 24th day of August 1897 Probate of this will was granted at
Gloucester to John Hodges Williams Henry Privett Thurston and Joseph
Staley the executors
